2. Description of Service

DuaLyric is an iOS mobile application designed to help users learn Spanish through music. Our service includes:

• Integration with Apple Music for song playback and search
• Time-synchronized lyrics display
• AI-powered English translations of Spanish lyrics
• Interactive comprehension quizzes
• Real-time voice explanations of lyrics and cultural context
• Progress tracking and learning analytics

3. Eligibility

You must be at least 13 years old to use DuaLyric. If you are between 13 and 18 years old, you must have your parent or legal guardian's permission to use the App. By using the App, you represent and warrant that you meet these age requirements.

4. Apple Music Integration

4.1 Required Subscription

To access music playback features, you must have an active Apple Music subscription. DuaLyric does not provide music streaming services directly and relies on Apple's MusicKit framework.

4.2 Authorization

You must authorize DuaLyric to access your Apple Music account. You can revoke this authorization at any time through your iOS device settings.

4.3 Apple's Terms

Your use of Apple Music through our App is also subject to Apple's Terms of Service and Apple Music Terms and Conditions.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality or security
• Use automated systems or software to extract data from the App
• Share your Apple Music credentials with others
• Violate any applicable laws or regulations while using the App

6. Intellectual Property Rights

6.1 Our Content

The App and its original content, features, and functionality are owned by DuaLyric and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content

Music content is provided through Apple Music and is subject to Apple's licensing agreements. Lyrics are sourced from lrclib.net and other publicly available databases. AI-generated translations and quizzes are created using OpenAI's services.

6.3 User-Generated Content

Any feedback, suggestions, or ideas you provide about the App may be used by us without compensation or attribution.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App. By using the App, you consent to the collection and use of information in accordance with our Privacy Policy.

8. AI-Powered Features

8.1 Translation Accuracy

AI-generated translations are provided for educational purposes and may not always be perfectly accurate. We recommend using multiple sources for critical language learning needs.

8.2 Quiz Content

Comprehension quizzes are automatically generated based on song lyrics and may vary in difficulty and accuracy. Quiz results should be used as learning aids, not definitive assessments.

8.3 Voice Explanations

Voice explanations are generated in real-time using AI technology. Audio quality may vary based on network conditions and device capabilities.

9. Disclaimers

9.1 Educational Purpose

DuaLyric is designed for educational and entertainment purposes. It is not a substitute for formal language education or professional language instruction.

9.2 Service Availability

We strive to maintain continuous service availability but cannot guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or technical issues.

9.3 Third-Party Services

The App relies on third-party services (Apple Music, OpenAI, lrclib.net) which may experience outages or changes that affect our service functionality.

10. Limitation of Liability

To the fullest extent permitted by law, DuaLyric and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the App.

11. Indemnification

You agree to defend, indemnify, and hold harmless DuaLyric and its affiliates from any claims, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App or violation of these Terms.

12. Termination

12.1 Termination by You

You may terminate your use of the App at any time by uninstalling it from your device and revoking Apple Music authorization.

12.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

12.3 Effect of Termination

Upon termination, your right to use the App will cease immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect.

13. Updates and Modifications

13.1 App Updates

We may release updates to improve functionality, security, or compatibility. Some updates may be required for continued use of the App.

13.2 Terms Updates

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which DuaLyric is incorporated, without regard to conflict of law principles.

16. Dispute Resolution

Before filing any formal dispute, you agree to first contact us to attempt to resolve the issue informally.

16.2 Arbitration

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except where prohibited by law.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DuaLyric regarding the use of the App and supersede all prior agreements and understandings.

19. App Store Terms

Your use of the App is also subject to the Apple App Store Terms of Service. In case of conflict between these Terms and the App Store Terms, the App Store Terms shall prevail regarding your relationship with Apple.

By using DuaLyric, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
